Videary Terms of Service

Acceptance

By downloading, installing, or using Videary, you agree to these Terms of Service. If you do not agree to these Terms, do not use the app.

The Service

Videary is an offline-first multimedia journal. You can write text entries (with an optional image), record voice notes, and capture short video entries, and organize them with moods, favorites, and exact-date filters in a compact archive-style design with retro themes.

Videary requires no account and no login. All of your data is stored only on your device, and Videary has no servers and no cloud service.

Eligibility & Age

You must be at least 13 years old (or the applicable age of digital consent in your country) and legally able to enter a binding contract to use Videary. If you are under 13, do not use the app.

License

Subject to your compliance with these Terms, Videary grants you a personal, limited, non-transferable, non-exclusive license to use the app on devices that you own or control.

Free Plan & Premium

Videary is free to use, supported by advertising. The free plan limits text entries to 900 characters and audio and video recordings to 90 seconds each.

Premium unlocks unlimited entries and removes ads. Premium can be purchased as a monthly or yearly subscription, or as a one-time lifetime purchase, through the Apple App Store or Google Play.

Purchases, Renewals & Refunds

All Premium purchases are processed by Apple (App Store) and Google (Google Play). Subscriptions auto-renew until cancelled.

Cancellation, renewal management, and refunds are handled exclusively through the App Store or Google Play, and are subject to their policies. Videary does not process payments and cannot issue refunds.

Subscription Renewal & Cancellation

Premium subscriptions are auto-renewing. Unless auto-renew is turned off at least 24 hours before the end of the current period, your subscription will automatically renew for the same price and period. You can manage or cancel your subscription at any time in your device's account settings (Apple App Store / Google Play settings).

The lifetime purchase unlocks Premium permanently on the device where purchased, subject to store policies.

Prices may change. Any price change will apply in accordance with your store's policies, and you will be notified by the store before renewal at a new price.

Advertising

The free plan displays ads served by Google AdMob. In the EEA/UK, your consent is requested through Google's User Messaging Platform (UMP), where you can choose personalized or non-personalized ads.

How ad-related data is handled is described in the Privacy Policy.

Third-Party Services & Advertising

Videary has no control over, and is not liable or responsible for, the content, accuracy, availability, or advertising messages of third-party services — including Apple, Google, AdMob, and any links or services reachable from the app — or their privacy practices. You interact with third-party services at your own risk.

Refunds for Premium purchases are handled exclusively by the store. See Apple's refund policy (support.apple.com/en-us/HT212009) or Google Play's refund policy (support.google.com/googleplay/answer/2479637) — see your store's refund policy for details.

User Content

Your entries and media belong to you and are stored only on your device. You are responsible for the content you create and for keeping it lawful.

No Backup

Videary does not offer cloud backup or data recovery. You are solely responsible for backing up your data.

Deleting the app, clearing its data, or losing the device may result in permanent loss of your entries.

Device & Media Disclaimer

Entries, media files, audio and video recordings, and images may be subject to corruption, format incompatibility, or loss. Videary is not liable for any corrupted, unreadable, or lost files.

You are solely responsible for maintaining your own backups. Videary provides no cloud backup, even for Premium users, and does not recover data from lost, stolen, or replaced devices.

Acceptable Use

Do not use Videary for illegal activity or for content that violates applicable law or the rights of others. In particular, you agree not to:

  • create or store illegal content, or content that infringes the intellectual property rights or privacy of others;
  • reverse engineer, decompile, or disassemble the app, except as permitted by applicable law;
  • interfere with or disrupt the service, its delivery, or the devices on which it runs; or
  • attempt to access content or data belonging to another user.

Because all of your data is stored locally on your own device, you are responsible for how the app is used on your device.

Intellectual Property

Videary grants you a personal, non-exclusive, non-transferable, and revocable license to use the app, subject to these Terms. All rights not expressly granted to you are reserved by Videary.

The Videary name, logo, design, and software are owned by Videary. You retain all rights to your own entries and media: your content is created and stored locally on your device, is not transmitted to Videary, and no rights to it are transferred to Videary.

Service Availability & Changes

The service may be suspended, interrupted, changed, or discontinued at any time, with or without notice. Videary does not guarantee that the service, or any part of it, will remain available.

Updates may be required and may change or remove features. Your continued use of the app after an update constitutes acceptance of the updated version.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Videary makes no warranties of non-infringement or accuracy, and does not guarantee that the service will be error-free or uninterrupted. You download and use the app at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Videary is not liable for indirect, incidental, special, or consequential damages, including loss of data or loss of profits, arising from your use of the service.

To the maximum extent permitted by law, Videary and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of content, or device damage. In no event shall the total aggregate liability exceed the amount you paid for Premium in the 12 months preceding the claim, or $50, whichever is less.

Termination & Suspension

You may stop using Videary at any time by deleting the app and its data. These Terms apply while you use the service.

Videary may suspend or terminate your access to the service — including Premium access, in cases of fraud, abuse, or breach of these Terms — at its discretion, with or without notice, except as prohibited by applicable law. Termination does not affect your store refund rights, which are governed by the policies of the App Store or Google Play.

Severability, Waiver & Entire Agreement

If any provision of these Terms is held to be unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. The failure of Videary to enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms constitute the entire agreement between you and Videary regarding your use of the service. You may not assign these Terms or any of your rights under them without Videary's prior written consent.

Mandatory Consumer Rights

Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country or the EEA/UK. Where a conflict arises between these Terms and those mandatory rights, your mandatory rights prevail.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules. Subject to mandatory law that gives you the right to bring proceedings in your country of residence, any disputes will be subject to the exclusive jurisdiction of the courts of the Republic of Turkey.

As an individual operator, we ask that you first address any dispute to us at support@videary.barisdev.tech or via our GitHub issues page, so that we can resolve it directly.

Changes

Videary may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.
